Оно было подписано в 2003 году президентами Владимиром Путиным и Леонидом Кучмой, и в нем за Азовом закреплялся статус исторически внутреннего моря (для обеих стран). Это положение и поставлено теперь под сомнение новой украинской властью, считающей, что Кучма подписал документ под давлением России.
Как сказал журналистам в Москве по окончании переговоров Антон Бутейко, Украина хотела бы придать акватории Азовского моря статус, который соответствовал бы нормам международного права (что означает переход его под международную юрисдикцию). По утверждению Бутейко, возможность вносить изменения в соглашение прописана в самом документе.
Однако с корректировкой договора не согласна Россия. Посол по особым поручениям МИД РФ Валерий Кеняйкин заявил по итогам переговоров: «Методы разграничения пространств оказались несовпадающими». Кеняйкин также подчеркнул: «Изменение статуса Азовского моря является вопросом не техническим, а политическим. И этот вопрос может осложнить переговорный процесс и завести его в тупик». Чтобы вернуть переговоры в конструктивное русло, Антон Бутейко, по его же словам, и предложил российским коллегам внести в российско-украинский договор о разграничении Азовского моря изменения.
Между тем в ситуации по Азову есть еще одна деталь, о которой дипломаты не упоминают. Это условие, прописанное в Керченском соглашении. Оно предполагает, что ни одно из иностранных судов не может пропускаться украинскими пограничниками без соответствующего согласования с российскими коллегами. Три года назад Леонид Кучма заверял российских дипломатов в том, что без согласия россиян через пролив даже мышь не проскочит. Теперь, когда Украина буквально стоит на пороге вступления в НАТО, вопрос Керченского пролива приобретает для России особую важность. Известный украинский политолог Виктор Небоженко по этому поводу сказал «НГ», что для Киева он не менее значим. «Требования украинской стороны пересмотреть договор по Азову в числе прочего диктуются будущим статусом Украины как члена альянса», – сказал политолог. Однако, отметил он, «вопрос прохождения судов через пролив необходимо отрегулировать вместе с Россией, без этого феодосийский скандал (протест в Крыму против захода корабля НАТО. – «НГ») покажется нам цветочками».
Между тем в МИД РФ заявляют, что продолжение российско-украинских переговоров по азово-керченской проблематике будет зависеть от официального разъяснения Киева по поводу внесения им предложения пересмотреть фундаментальные положения соответствующего договора между РФ и Украиной.
